Wise's departure or to possible alternative methods of meeting

the difficulties set out by Your Honour, I will allude to two

separate issues which arise out of this question. The first

concerns the fact (which Your Honour has mentioned) that so

long as there are only two Judges, the Appeal Court consists

only of two, and the Chief Justice has a preponderant voice. I

concur that this is not a satisfactory position, either for

Appellants or for Your Honour, and it constitutes I think by

itself a strong argument - but not a new one - for the appoint-

wment of a Third Judge. In Colonies with which I have been con-

-nected the Chief Justices and Pulsne Judges of contiguous

administrations form an Appeal Court. I would suggest on this

analogy for your consideration the possibility of arranging for

an Appeal Court composed of the Judges of Hongkong and Shanghai.

The second point is that Your Honour complains that you have no

qualified Judge with whom to consult in important cases. Your

Honour, however, excludes Mr.-Justice Wise on the grounds that

he has his own Court to attend to and it is difficult to

arrange consultations at suitable times. The same arguments

Would appear to apply to a Third Judge if it be admitted that

the work is so heavy as to fully employ him.

The departure of Mr. Justice Wise on leave

will no doubt be a serious loss to the Bench. Your Honour has expressed
